Help with Returns & Transport Damage

Please note: This translation is provided for informational purposes only. The legally binding version of this document is the German "Widerrufsbelehrung" (Right of Withdrawal). In the event of any discrepancy, the German version shall prevail.

It is very important to me that my artworks arrive at your home safely and in perfect condition. If something should not fit, you will find all the information on how to proceed here.

1. What to do if an item arrives damaged? (Claims)

If your package or its contents arrive damaged, don't worry! We will find a quick solution.

  • The most important step: Please take photos of the damaged packaging before opening it, and of the damaged artwork itself immediately.
  • Contact me: Send me an email at mail@sabinegorus-art.com within 24 hours. Please include the photos and a brief description of the damage.

What happens next?

  • For Fine Art Prints: Once I have received your photos, I will forward the claim to my print lab. A new print will be sent to you free of charge. As a rule, you do not need to return the damaged print.
  • For Originals & Commissions: Since these are unique pieces, we will find an individual solution (e.g., repair, reduction in price, or insurance claim). We will clarify everything personally via email.

2. You wish to return your purchase? (Withdrawal)

If you have received a fine art print from my shop and it does not meet your expectations, you can exercise your legal right of withdrawal.

  • Notification: Please write me a brief email in advance at mail@sabinegorus-art.com with your name and order number. It helps me a lot if you briefly state the reason or send a photo if you are dissatisfied with the color representation (please note, however, that slight color variations can occur for technical reasons due to different screen settings).
  • Return Address: After receiving your email, I will inform you of the address to which the return should be sent.
  • Packaging & Costs: Please use the original packaging for the return shipment. This is the only way to ensure the print is optimally protected from creasing. As the buyer, you bear the direct costs of insured return shipping and are responsible for ensuring the goods arrive undamaged.

Note on individual artworks: Please note that, in accordance with legal regulations, the right of withdrawal does not apply to individual commissioned paintings, as these were produced according to your personal wishes.

A. Right of Withdrawal

Introduction

Consumers are entitled to a right of withdrawal according to the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity:

Right of Withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken or has taken possession of the last goods.

To exercise your right of withdrawal, you must inform us (Sabine Claudia Gorus, c/o flexdienst – #20671, Kurt-Schumacher-Straße 76, 67663 Kaiserslautern, Germany, Phone: +49 15678307937, Email: mail@sabinegorus-art.com) by means of a clear statement (e.g., a letter sent by post or an email) of your decision to withdraw from this contract. You may use the attached model withdrawal form, but it is not mandatory.

You can also fill in and submit the model withdrawal form or another clear declaration electronically on our website https://sabinegorus-art.com/pages/eu-widerrufsformular. If you make use of this option, we will communicate to you an acknowledgement of receipt of such a withdrawal without delay (e.g. by e-mail).

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. For this reimbursement, we will use the same means of payment that you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You will bear the direct cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

Exclusion or Premature Expiry of the Right of Withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The right of withdrawal does not apply to consumers who do not belong to a member state of the European Union at the time the contract is concluded and whose sole place of residence and delivery address are outside the European Union at the time the contract is concluded.

General Information

  1. Please avoid damage and contamination of the goods. Please return the goods in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer possess the original packaging, please provide adequate protection against transport damage with suitable packaging.
  2. Please do not return the goods freight collect (unfree).
  3. Please note that the aforementioned items 1-2 are not a prerequisite for the effective exercise of the right of withdrawal.
